SleepTrace - Terms Of Use

These Terms of Use ("Terms") govern your access to and use of the Sleep Trace mobile application ("App") provided by GROW APP SOLUTIONS LLP ("we," "our," or "us").

By downloading, accessing, or using Sleep Trace, you agree to these Terms. If you do not agree with these Terms, please do not use the App.

1. Use of the App

Sleep Trace is designed to help users track, monitor, and analyze sleep-related information, including sleep duration, sleep stages, sleep sounds, snoring, and other supported sleep and wellness information.

The App may use Apple HealthKit data and microphone-based features to provide sleep tracking and analysis functionality.

You may use the App only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Use the App for any unlawful or unauthorized purpose.

  • Attempt to interfere with or disrupt the App or its services.

  • Attempt to gain unauthorized access to any part of the App.

  • Reverse engineer, modify, decompile, or attempt to extract the source code of the App, except where permitted by applicable law.

  • Use the App to distribute harmful, fraudulent, abusive, or illegal content.

  • Use the App in a way that could damage, disable, or negatively affect the App or other users.

  • Attempt to misuse, manipulate, or interfere with the App's sleep tracking, analysis, advertising, or subscription features.

2. Health and Sleep Information

Sleep Trace may allow you to access and analyze information available through Apple HealthKit, including:

  • Sleep duration

  • Sleep stages, including Deep, Core, and REM

  • Time asleep

  • Time in bed

  • Heart rate

  • Respiratory rate

You understand that Sleep Trace is intended for general sleep and wellness purposes.

The App is not a medical device and is not intended to diagnose, treat, cure, prevent, or monitor any disease, medical condition, or health disorder.

Sleep information, sleep scores, insights, sound detection, and other information provided by the App should not be considered medical advice or a substitute for consultation with a qualified healthcare professional.

You are responsible for deciding whether and how to use information provided by the App.

3. Microphone and Sleep Audio

Sleep Trace may use your device microphone to provide features such as:

  • Sleep sound detection

  • Snoring detection

  • Sleep sound recording

  • Sleep analysis

Microphone audio is processed on your device for supported sleep features.

Sleep recordings may be stored locally on your device. The App does not upload your microphone recordings to our servers or cloud services for analysis.

You are responsible for ensuring that your use of the recording functionality complies with applicable laws and respects the privacy and consent of other people who may be recorded.

4. Device Permissions

Certain Sleep Trace features may require access to device permissions, including:

  • Health / HealthKit: To access supported sleep and health information for sleep tracking and analysis.

  • Microphone: To detect and record sleep sounds, including potential snoring, and provide sleep analysis features.

  • Notifications: To provide sleep reminders, reports, alerts, or other App-related notifications.

  • App Tracking Transparency (ATT): To request permission for tracking and personalized advertising where applicable.

You may allow or deny these permissions through Apple's system permission settings.

Some App features may not function properly if the required permission is denied.

5. Intellectual Property

All rights, title, and interest in and to the Sleep Trace App, including its design, interface, graphics, logos, features, software, text, sleep analysis presentation, and other materials provided by us, are owned by or licensed to GROW APP SOLUTIONS LLP.

You may use the App for personal and lawful purposes, but you may not copy, reproduce, distribute, modify, sell, or commercially exploit our intellectual property without our prior written permission.

6. In-App Purchases and Subscriptions

Sleep Trace may offer optional paid features, in-app purchases, or auto-renewable subscriptions.

Paid features may provide access to premium sleep tracking, analysis, recordings, insights, or other functionality offered within the App.

All purchases are processed through Apple's App Store and are subject to Apple's applicable payment and subscription terms.

By purchasing a subscription or other paid feature, you authorize Apple to charge the applicable amount to your Apple Account according to the selected purchase.

Subscription pricing, duration, trial periods, and available offers will be displayed within the App or through the App Store.

7. Subscription Renewal and Cancellation

If Sleep Trace offers auto-renewing subscriptions, your subscription may automatically renew unless you cancel it before the end of the current subscription period.

You can manage or cancel your subscription through your Apple Account settings.

Deleting the App does not necessarily cancel an active subscription.

Any applicable refund requests are handled according to Apple's refund policies and procedures.

8. Free Trials and Promotional Offers

Sleep Trace may offer free trials, introductory offers, promotional pricing, or other special offers from time to time.

The terms of each offer, including duration and eligibility, will be presented at the time the offer is made.

Unless otherwise stated, a free trial or promotional subscription may automatically convert to a paid subscription after the trial or promotional period ends.

9. Advertisements

Sleep Trace may display advertisements provided by third-party advertising partners.

Advertisements may be personalized depending on your ATT permission, device settings, and applicable laws.

HealthKit information, including sleep data, sleep stages, heart rate, and respiratory rate, is not used to personalize, target, or measure advertisements.

We are not responsible for the content, accuracy, availability, or practices of third-party advertisements or external services promoted through advertisements.

10. Third-Party Services

The App may use or integrate with third-party services, including Apple's services, HealthKit, advertising services, analytics services, crash-reporting services, payment services, and other service providers.

Your use of third-party services may be subject to the terms and privacy policies of those third parties.

We are not responsible for the availability, functionality, or policies of third-party services.

11. Availability and Updates

We may modify, update, suspend, or discontinue any part of Sleep Trace at any time, with or without notice, where permitted by applicable law.

We may release updates to improve functionality, security, compatibility, or performance.

You may need to install updates to continue using certain features of the App.

12. Disclaimer

Sleep Trace is provided on an "as is" and "as available" basis, to the extent permitted by applicable law.

We do not guarantee that:

  • The App will always be available or uninterrupted.

  • The App will be completely free from errors or bugs.

  • Sleep tracking or sleep sound detection will always be accurate.

  • Sleep stages, sleep duration, snoring detection, or other sleep-related information will be completely accurate.

  • All features will always be available.

  • The App will meet every user's specific requirements.

  • Any locally stored sleep recordings or other App data will never be lost or damaged.

Sleep Trace is intended for general wellness and sleep-tracking purposes and should not be relied upon as a medical or diagnostic tool.

You are responsible for maintaining appropriate backups of any important information or recordings stored on your device.

13. Limitation of Liability

To the maximum extent permitted by applicable law, GROW APP SOLUTIONS LLP shall not be liable for any indirect, incidental, special, consequential, or other damages arising from or related to your use of, or inability to use, Sleep Trace.

This includes, without limitation, loss of data, loss of recordings, loss of profits, business interruption, or other losses resulting from the use of the App.

We are not responsible for decisions made based on sleep information, sleep scores, sound detection, or other information provided by the App.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

14. Termination

We may suspend or terminate your access to Sleep Trace if you violate these Terms or misuse the App.

You may stop using the App at any time by deleting it from your device.

Termination will not affect any rights or obligations that arose before termination.

15. Privacy

Your use of Sleep Trace is also governed by our Privacy Policy, which explains how information and permissions are handled.

The Privacy Policy describes how the App handles HealthKit information, microphone and sleep recordings, device information, advertising, analytics, and other information.

By using Sleep Trace, you acknowledge that you have reviewed our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to Sleep Trace, our services, or applicable laws.

When we make changes, we will update the Effective Date at the beginning of these Terms.

Your continued use of Sleep Trace after updated Terms become effective means that you accept the revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the applicable laws of India, without regard to conflict-of-law principles.

Any disputes relating to these Terms or the App shall be subject to the jurisdiction of the applicable courts in India.
